These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Employee"), and Digital Web Hub ("we," "us," or "our"), concerning your access to and use of the Dawamak mobile application (the "Application").
By downloading, installing, or using the Application, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Application and must discontinue use immediately.
Your account on the Application is created and managed by your employer ("Employer"). Your Employer is responsible for providing us with the necessary information to create your account, such as your name, email, and phone number.
You are responsible for maintaining the confidentiality of your login credentials (email and password) and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security.
We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the Application on a mobile device owned or controlled by you, strictly in accordance with these Terms and as required by your Employer for attendance and location tracking purposes.
You agree not to use the Application for any purpose that is prohibited by these Terms or by law. You shall not:
Your use of the Application is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. You acknowledge and agree that we will collect personal data, including your name, contact information, real-time GPS location, and photographs at check-in and check-out times. This information will be shared exclusively with your Employer for the purpose of workforce management, attendance verification, and payroll processing.
The Application, including its source code, design, logos (such as the Dawamak logo), text, and graphics, are the property of Digital Web Hub and are protected by copyright and other intellectual property laws. You are not permitted to copy, modify, or distribute any part of the Application without our prior written consent.
The Application is provided on an "as-is" and "as-available" basis. We make no warranty that the Application will be uninterrupted, timely, secure, or error-free. The accuracy of GPS location data is dependent on your device's capabilities, signal strength, and other factors beyond our control, and we do not guarantee its absolute accuracy.
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Application. We are not a party to the employment relationship between you and your Employer. Any disputes related to your employment, including but not limited to work hours, pay, or attendance records, must be resolved directly with your Employer.
We reserve the right to suspend or terminate your account and access to the Application at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users of the Application, us, or third parties.
Your access to the Application is contingent upon your employment status. If your employment is terminated, your Employer is responsible for deactivating your account, and your access to the Application will cease.
These Terms and your use of the Application are governed by and construed in accordance with the laws of the Republic of India. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts located in Uttar Pradesh, India.
We may modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date of these Terms. You are encouraged to periodically review these Terms to stay informed of our updates.
